Rule #1 - Electronic Service and Delivery Rule

This rule applies to service and delivery of the following documents and information:

  • Any document or information issued by the Superintendent under the Mortgage Brokerages, Lenders and Administrators Act, 2006, S.O. 2006, c. 29.

In this rule, "e-mail address" means the last electronic mail address provided by a regulated sector participant or by their agent or authorized service provider on their behalf, to the Superintendent of Financial Services;

"Person" includes an individual, corporation, partnership or other entity; and

"Business day" means a day that is not a Saturday or holiday within the meaning of section 87 of the Legislation Act, 2006.

The Superintendent of Financial Services may serve or deliver any document or information required or permitted to be served upon, or issued to, as the case may be, any person under any Act administered by him or her, by sending the document or information to that person’s e-mail address.

Any document or information delivered to an e-mail address under this rule will be deemed to be received and any service effected on the day the electronic transmission is made provided that day is a business day.

Any document or information delivered after 5 p.m. on a business day or on a Saturday or holiday is deemed to have been delivered on the next business day.
