REGARDING the Mortgage Brokerages, Lenders and Administrators Act, 2006, S.O. 2006, c.29, (the “Act”) in particular sections 16 and 21

AND REGARDING Godefrey Clarke.


On October 3, 2016, the Superintendent of Financial Services (“Superintendent”) issued a Notice of Proposal to refuse to renew the Mortgage Broker licence application of Godefrey Clarke (“Mr. Clarke”) (licence #M08008619). Mr. Clarke requested a hearing before the Financial Services Tribunal (“FST”) on October 21, 2016.

A Pre-Hearing Conference was held on January 4, 2017, by teleconference. Mr. Clarke failed to appear at the Pre-Hearing Conference and it was adjourned.

On January 4, 2017, the FST issued a Notice of Intention to Dismiss that proposed to dismiss the proceeding without a hearing if Mr. Clarke did not provide reasonable cause for his failure to appear at the Pre-Hearing Conference within 30 days. No reasonable cause was provided.

On February 22, 2017, the FST ordered that the proceeding was dismissed without further notice.

Pursuant to subsection 21(7) of the Act, the Superintendent makes the following order.


The application by Godefrey Clarke to renew his Mortgage Broker licence is hereby refused.
