To the attention of all insurance companies licensed
to transact automobile insurance in Ontario
With this Bulletin, the Ontario Insurance Commission (OIC) is issuing new forms for statutory accident benefits claims. The new forms reflect changes to the automobile insurance system brought about in Bill 59, the Automobile Insurance Rate Stability Act, 1996 and the Statutory Accident Benefits Schedule (SABS). These 19 new forms will apply to accidents on or after November 1, 1996.
In addition, eight of the new forms are designed to be used for accident claims under both the new Bill 59 and the current Bill 164.
For convenience, the attached schedule sets out the forms that apply to Bill 59 claims, and those that apply to Bill 164 claims. The existence of two sets of forms is an inevitable result of the transition to the new system. You will note that 11 forms will apply exclusively to Bill 59 claims (these are identified by the designation "/59" after the form code), eight forms apply exclusively to Bill 164 claims, and eight forms are common to both systems.
The new and revised forms were developed by an industry-government task group in consultation with the Insurance Bureau of Canada. The OIC appreciates the care and attention that insurers are exhibiting in managing the necessary form changes in the transition to the new system. It should be noted that of the 11 forms that will apply exclusively to Bill 59 claims, five are new forms required under the SABS, while the other six are modifications to existing forms under Bill 164. The new forms are noted on the attached schedule with an asterisk.
Insurers should also note that changes have been made to Form 1, ("Assessment of Attendant Care Needs"). The revised version will be available following its publication in a forthcoming edition of The Ontario Gazette. The OIC will announce its availability in due course.
