Auto Insurance Dispute Resolution System Project Update

As of April 1, 2016, the Automobile Accident Benefits Service (AABS) [New Window] at the Safety, Licencing Appeals and Standards Tribunal of Ontario will assume all new applications for dispute resolution services.

As of April 1, 2016, FSCO will no longer accept applications for mediation, neutral evaluation and arbitration. This includes applications for arbitration where the report of the Mediator is issued before or after April 1, 2016.

 

This means that even if an Application for Mediation was received by March 31, 2016, you may not file an application for arbitration at FSCO or proceed to court following a failed mediation.


Applications received by FSCO on or after April 1, 2016, will be returned to the sender. FSCO will not redirect applications to the AABS.

FSCO will continue to be responsible for all files remaining open as of March 31, 2016.

FSCO reminds insurers to update the wordings to be used for denial letters on and after April 1, 2016. Letters sent on and after April 1, 2016, must direct claimants to the AABS for information on disputing a claim.
