Multi-jurisdictional pension plans-filing of amendments related to pension legislation proclaimed in Alberta, British Columbia and Nova Scotia

British Columbia:

British Columbia’s Pension Benefits Standards Act and Regulation (new Act and Regulation[New Window] have been proclaimed effective September 30, 2015.  To comply with changes to the new Act and Regulation, pension plans registered with the British Columbia pension regulator are required to file plan amendments with the British Columbia pension regulator by December 31, 2015.
 
Update – December 2015: The British Columbia pension regulator has extended the deadline for filing amendments with respect to the new Act and Regulation from December 31, 2015 to March 31, 2016.
 

 

Alberta:

Alberta’s Employment Pension Plans Act (EPPA) and Regulations were proclaimed effective September 1, 2014. To comply with changes to the EPPA, pension plans registered with the Alberta pension regulator are required to file plan amendments with the Alberta pension regulator.  In recognition of Alberta and British Columbia’s harmonized pension regulatory environment, Alberta has now extended the deadline for filing amendments with respect to the EPPA to December 31, 2015 (see announcement [New Window] and update [New Window] for more information).
 

Nova Scotia:

Nova Scotia’s new Pension Benefits Act and Regulation have come into force on June 1, 2015.  To comply with changes to the new Act and Regulation, the Nova Scotia pension regulator announced [New Window] that amendments to the plan text to reflect the new required plan provisions must be filed before June 1, 2018.
 

Note:

For those multi-jurisdictional pension plans registered with the Financial Services Commission of Ontario (FSCO) that have Alberta, British Columbia and Nova Scotia members, plan amendments are due to be filed with FSCO as follows:

 

  • by December 31, 2015: amendments related to the requirements of the Alberta EPPA
  • by March 31, 2016: amendments related to the requirements of British Columbia's new Act and Regulation; and,
  • by June 1, 2018: amendments related to the requirements of Nova Scotia's new Pension Benefits Act and Regulation.  

No application is required for this extension.
