ORDER

ON OR ABOUT July 2, 2014, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Intended Decision (the “NOID”) in respect of the Registered Pension Plan for Employees of Chinook Mobile Heating & Deicing Corporation, Registration Number 1224047 (the “Plan”), intending to make the following orders: that the Plan be wound up as at the date that the Intended Order set out in the NOID is issued; that Chinook Mobile Heating & Deicing Corporation as Administrator of the Plan (“Chinook”) file an Annual Information Return for the Plan for the year 2012 and Financial Statements for the Plan for the years 2011 and 2012 within thirty (30) days from the date the Intended Order in the NOID is issued; that Chinook file a Summary of Contributions for the years 2013 and 2014 with the Plan fund trustee and custodian, The Manufacturers Life Insurance Company within thirty (30) days from the date the Intended Order in the NOID is issued; and that Chinook remit all outstanding contributions, plus interest thereon calculated to the date of payment, to the Plan fund within thirty (30) days from the date the Intended Order in the NOID is issued.

NO REQUEST FOR HEARING was delivered to the Financial Services Tribunal by the Applicant or any other person within the time prescribed by section 89(6) of the PBA.

For the reasons set out in the NOID, I ORDER that:

  1. The Registered Pension Plan for Employees of Chinook Mobile Heating & Deicing Corporation, Registration Number 1224047 be wound up as at the date of this Order pursuant to sections 69(1)(a) and 69(1)(b) of the PBA.


  2. Chinook Mobile Heating & Deicing Corporation file an Annual Information Return for the Plan for the year 2012 within thirty (30) days from the date of this Order pursuant to section 20(1) and section 87(2)(c) of the PBA.


  3. Chinook Mobile Heating & Deicing Corporation file Financial Statements for the Plan for the years 2011 and 2012 within thirty (30) days from the date of this Order pursuant to sections 20(2) and 87(2)(c) of the PBA and section 76 of Ontario Regulation 909, as amended.


  4. Chinook Mobile Heating & Deicing Corporation file a Summary of Contributions for the years 2013 and 2014 with the Plan fund trustee and custodian, The Manufacturers Life Insurance Company within thirty (30) days from the date of this Order pursuant to sections 56.1 and 87(2)(c) of the PBA.


  5. Chinook Mobile Heating & Deicing Corporation remit all outstanding contributions, plus interest thereon calculated to the date of payment, to the fund maintained for the Registered Pension Plan for Employees of Chinook Mobile Heating & Deicing Corporation, Registration Number 1224047 within thirty (30) days from the date of this Order pursuant to sections 55(2) and 87(2)(c) of the PBA.
