ON OR ABOUT June 18, 2018, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Intended Decision (the “NOID”) refusing to order the OPSEU Pension Trust to permit R.B., a suspended member of the Ontario Public Service Employees’ Union Pension Plan, Registration Number 10102046 (the “Plan”), to withdraw his accrued pension benefit as a lump sum or to withdraw a refund of his past contributions, pursuant to sections 42 and 87 of the PBA.

A REQUEST FOR HEARING dated July 9, 2018, was received by the Financial Services Tribunal (the “Tribunal”) from R.B. on July 9, 2018.

AN APPLICATION FOR PARTY STATUS was filed with the Tribunal by the OPSEU Pension Plan Trust Fund on August 10, 2018.

A PRE-HEARING CONFERENCE was held by the Tribunal on October 5, 2018.  Full party status was ordered for the OPSEU Pension Plan Trust Fund, and the pre-hearing conference was ordered to continue on January 29, 2019.

A WITHDRAWAL OF THE HEARING REQUEST was filed with the Tribunal by R.B. on November 16, 2018.

THE TRIBUNAL CLOSED ITS FILE on November 19, 2018.

For the reasons set out in the NOID, I REFUSE TO ORDER the OPSEU Pension Plan Trust Fund to permit R.B. to withdraw his accrued pension benefit as a lump sum or to withdraw a refund of his past contributions from the Ontario Public Service Employees’ Union Pension Plan.
