CONSENT
On or about September 18, 2006 the Superintendent of Financial Services caused to be served on Parmalat Food Inc. a Notice of Proposal dated September 18, 2006 to consent, pursuant to section 78(1) of the PBA, to payment out of the Dominion Dairies Division of Parmalat Food Inc. Pension Plan for Union Employees - Hamilton, Registration No.353425, to Parmalat Food Inc. in the amount of $381,901 as at July 31, 2005 and adjusted for expenses and interest to the actual date of payment.
No Notice requiring a hearing was delivered to the Financial Services Tribunal by the Applicant or any other party within the time prescribed by section 89(6) of the PBA.
THE SUPERINTENDENT OF FINANCIAL SERVICES THEREFORE CONSENTS to the payment out of the Dominion Dairies Division of Parmalat Food Inc. Pension Plan for Union Employees - Hamilton, Registration Number 353425, to Parmalat Food Inc. in the amount of in the amount of $381,901 as at July 31, 2005 and adjusted for expenses and interest to the actual date of payment.
THIS CONSENT IS EFFECTIVE ONLY AFTER the Applicant satisfies me that all the surplus entitlements of the former members have been paid or otherwise provided for in accordance with the terms of the Surplus Distribution Agreement.
