FSCO experienced a surge of PPA filings in the third and fourth quarters beyond its processing capacity, along with increasingly complex filings, including for new innovative products, requiring more analytical and actuarial resources. As a result, the approvals of some filings were delayed. FSCO will work to anticipate and address potential resource issues in the future.

A significant number of standard filings required follow-up interactions with insurers to seek additional submissions or corrections before FSCO arrived at a final decision. In these cases, FSCO required additional time to review the filings. FSCO’s current methodology for reporting approval times does not take into account all of the interactions associated with such filings. We will continue reviewing how these interactions are captured in our reporting methodology to more accurately reflect the number of days it takes to complete more complicated filings.

* The service standards were developed prior to the amendments to the Automobile Insurance Rate Stabilization Act (AIRSA) and did not contemplate a re-filing of rates by the majority of the industry at one point in time.

 

The service standards were developed based on historical practice where insurers filed voluntarily.  Based on the new provisions under AIRSA, the Superintendent ordered insurers to file rates and more extensive documentation was required and prepared by FSCO, in order to ensure a fair process and  in the event that any insurers proceeded to judicial review.
