IN THE MATTER OF REGARDING the Mortgage Brokerages, Lenders and Administrators Act, 2006, S.O. 2006, c. 29, as amended (the “Act”), in particular sections 14 and 21;
AND IN THE MATTER OF Andre Fillion (“Fillion”).
ORDER REFUSING TO RENEW LICENCE
Fillion’s mortgage agent licence (licence M08004704) expired on March 31, 2018 (the “Licence”). On August 2, 2018, Fillion submitted an application to renew the Licence.
On March 18, 2019, the Superintendent of Financial Services (the “Superintendent”) issued a Notice of Proposal (the “Notice”) to refuse to renew the Licence.
The Notice was served on Fillion pursuant to the requirements of the Act. On April 9, 2019, Fillion requested a hearing before the Financial Services Tribunal (“Tribunal”).
On June 8, 2019, the Financial Services Regulatory Authority of Ontario (“FSRA”) assumed the regulatory duties of the Financial Services Commission of Ontario (“FSCO”), and the Chief Executive Officer of FSRA (the “Chief Executive Officer”) assumed the regulatory duties of the Superintendent under the Act.
On January 11, 2021, the Tribunal dismissed the matter without a hearing pursuant to Rule 35.01 of the Tribunal’s Rules of Practice and Procedure.
Pursuant to section 21(7) of the Act, and by delegated authority from the Chief Executive Officer, the Director, Litigation and Enforcement makes the following order.
The mortgage agent licence application of Andre Fillion is hereby refused.
