To the attention of all insurance companies licensed to
transact commercial liability insurance in Ontario
The Financial Services Commission of Ontario (FSCO) is issuing this bulletin to confirm that a notice of collection under the Freedom of Information and Protection of Privacy Act (the FOIPOP Act) no longer needs to be sent by insurers to insureds regarding the Commercial Liability Statistical Plan (CLSP).
Insurers transacting commercial liability insurance in Ontario are required to report data to the CLSP.
In the past, insurers were asked to provide a notice to insureds about the potential for personal information being collected through the CLSP. FSCO has reviewed both the information collected under the CLSP and current requirements under the FOIPOP Act and is advising that this notice is no longer required as no personal information is being collected through the CLSP.
If, in future, personal information is sought, it will be necessary to provide an appropriate notice to insureds.
